The Fair Labor Standards Act (FLSA) establishes minimum wage, overtime pay and recordkeeping requirements for employees.

Covered nonexempt employees are entitled to a minimum wage and overtime pay at a rate of not less than one and one-half times the regular rate of pay for more than 40 hours of work in a workweek.

The FLSA requires most employees to be paid at least the federal minimum wage — currently $7.25 per hour — for all hours worked and overtime pay at time and a half the employee’s regular rate of pay for all hours worked over 40 hours in a workweek.

There are exceptions when an employee is not entitled to minimum wage or overtime pay. For example, employees who are bona fide executives, administrators, or professional and outside sales employees are exempt from the FLSA’s minimum wage and overtime requirements. To be exempt, employees must have certain job duties and be paid on a salary basis at not less than $455 per week. It is important to keep in mind that job titles don’t determine whether an employee is exempt or not.
